that would prohibit expiration dates on gift certificates
passed favorably out of the General Law Committee yesterday.
State Senator David Cappiello (R-Danbury), the Ranking Member
of the committee, along with fellow committee member State
Representative Mary Ann Carson (R-New Fairfield), are actively
pursuing this legislation and were pleased with yesterday’s
favorable report. “We’ve
drafted the legislation to include all gift certificates
and gift cards,” explained Senator Cappiello. “I
have seen some gift cards which expire only six months to
a year after they are issued, while others decrease in value
after a predetermined amount of time. Those who buy or receive
gift certificates ought to have a more extended period during
which to make their purchases without fear of the gift card
losing its value.”
In addition to eliminating all expiration dates on gift
cards, this legislation also would strike out the escheat
provisions that had been in effect. Current law requires
that money spent on gift certificates that go unclaimed
after three years be returned to the Office of the State
Treasurer by the businesses that issued them.
“This
legislation will protect consumers,” said Rep. Carson.
“The bill is a direct response to constituents who
experienced problems with a restaurant gift certificate
that had expired. Most people who receive gift certificates
don’t look for an expiration date. I’m hopeful
we will be able to pass this into law during the current
Legislative Session.” |
